The Unstaged Original

Generative tools can furnish an empty room or swap a grey sky in seconds. California now makes an AI-altered listing photo say so, and link to the unaltered original.

What is it?

A rule that makes an AI-altered listing photo carry a label and a route back to the real room. In California the unaltered original must be linked, and the largest MLS places it directly beside the staged image, so the buyer sees both versions of the same space.

Why now?

Generative tools now furnish rooms and swap skies in seconds. California’s AB 723 took effect in January 2026, and MLS rules followed with fines and feed duties. A vendor study found over 90% of altered portal photos undisclosed, and other states are starting to look.

Who’s building it?

Listing services, state legislators, staging-tool makers, portals and compliance vendors scanning uploads for AI edits.

01 · The market
Who’s in it
Builders — staging-tool makers and vendors that detect AI edits.
Buyers — house hunters comparing a generated room with the photo it came from.
Gatekeepers — listing services, state licensing law and portals that syndicate the photos.
What’s at stake
Whether the unaltered photo becomes the reference buyers trust, with the staged image read as a proposal.
Whether small MLS fines change how agents edit.
Whether pairing survives syndication to every portal and app.
What’s unsettled
Where colour correction ends and a sky swap becomes an alteration.
Whether any fine or suspension is actually issued to an agent.
Whether other states copy the original-beside-altered rule or stop at a simple label.
02 · How the demand matureda progression, not a timeline
Novelty
Empty rooms filled by generative staging draw clicks on crowded portals.
Retention
Buyers who feel misled by a photo stop trusting the listing.
Willingness to pay
Agents keep paying for staging, and now for tools that pair the original.
Category
Listing imagery becomes a regulated exhibit with the plain photo always attached.
03 · Where the market goesthe forks, not a prediction
→The paired standard: portals adopt original-beside-altered as default, and staging reads openly as a design proposal rather than a claim.
→Labels spread without originals, and buyers learn to ignore a small disclosure line.
→Upload scanning becomes routine, and listing services check every image for AI edits before anything is published.
→Enforcement stays at warnings, and undisclosed edits persist outside the largest markets.
The forks turn on whether listing services actually fine and suspend, and whether portals carry the original as faithfully as they carry the generated room.

The panel on this signal
They agreed on
–California law and MLS rules now require an AI-altered listing photo to travel with its unaltered original.
–The disclosure-gap figure comes from a single vendor’s study.
–No fine or suspension under the new rules has been reported so far.
The architectural photographer disagreed on
–Wide lenses, HDR blending and careful framing mislead more than staging, and every exemption leaves them untouched by the rule.
