The Clean Purge

“Clean beauty” has never had a legal definition, and still doesn’t. From 27 September 2026, the EU’s EmpCo Directive bans a self-certified clean or sustainability label without independent certification.

What is it?

The EU’s EmpCo Directive bans a self-certified sustainability or clean label unless it rests on independent certification, applying from 27 September 2026. It never defines clean; it only removes a brand’s power to certify its own claim, the thing that made the word unfalsifiable in the first place.

Why now?

Member states must transpose EmpCo by March 2026 and apply it that September, turning a marketing habit into a banned practice overnight. Alongside it, two funded start-ups pitch brands AI agents that check a claim before it runs — compliance-side tooling, not exposure.

Who’s building it?

EU regulators write the rule; funded compliance start-ups sell brands a pre-publication AI check against it.

01 · The market
Who’s in it
Regulators — the EU institutions that wrote and will enforce EmpCo.
Brands — beauty companies that must drop any self-certified clean or sustainability mark.
Vendors — start-ups selling AI checks against the new rule before a claim runs.
What’s at stake
A self-certified clean or sustainability label becomes illegal to display anywhere in the EU from 27 September 2026.
Which claims survive depends on real third-party certification now.
A compliance-tooling category is forming around the deadline, still unproven.
What’s unsettled
Whether any AI compliance platform has actually caught a real clean claim.
Whether brands quietly drop the word or seek real certification instead.
Whether the US ever tests clean claims by statute rather than case by case.
02 · How the demand matureda progression, not a timeline
Transposition
Member states write EmpCo into national law by March 2026.
Application
The display ban on self-certified labels takes effect that September.
Adoption
Brands review marketing copy against the new rule, by hand or with a paid AI check.
Litigation
US claims face the older route, a court testing one brand’s wording.
03 · Where the market goesthe forks, not a prediction
→Whether EmpCo’s certification requirement pushes brands toward real third-party marks like COSMOS or Ecocert, or just toward quieter wording.
→Whether a funded AI compliance platform gets adopted widely enough to matter, or stays a seed-stage pitch.
→Whether the US ever legislates the same certification requirement, rather than litigating each claim alone.
→Whether EmpCo’s enforcement record, once it starts, matches the strength of its text.
Whether removing a brand’s power to self-certify changes what ‘clean’ means on a shelf, or only changes who is allowed to say it.

The panel on this signal
They agreed on
–EmpCo removes a brand’s power to self-certify a clean or sustainability claim, without ever defining the word.
–The AI here checks a brand’s own claims before publication.
–Neither AI compliance start-up has a confirmed case of clearing a real claim.
The sustainability-certification auditor disagreed on
–An AI check against regulatory text is not the accredited, standards-based audit EmpCo’s certification requirement actually demands.
