The Admitted Agent

Courts are drawing the line on who may book for a traveller. A US court held the user directing an AI agent accesses the site, not the agent.

What is it?

An AI agent that books for a traveller must get past the seller’s door, and courts now decide how. A US appeals court treats the directing user as the visitor, while an Irish judge lets an airline press its account wall against a travel agency.

Why now?

Two rulings landed within a week. On 28 July 2026 the Irish High Court let Ryanair pursue eDreams, and on 4 August the Ninth Circuit reversed an injunction against an AI agent. Terms and contract claims stay open in both.

Who’s building it?

AI agent makers, airlines, online travel agencies, the courts hearing access cases and the lawyers drafting terms.

01 · The market
Who’s in it
Builders — agent makers routing bookings through the traveller’s own device.
Buyers — travellers who send an agent to book and expect it to be let in.
Gatekeepers — airlines with account walls, and the courts enforcing their terms.
What’s at stake
Whether a traveller’s consent is enough to admit an agent, or whether the seller’s permission is also needed.
Whether terms pages can lawfully shut out agents.
Whether anti-bot walls become the legal line itself.
What’s unsettled
Whether contract claims succeed where the hacking claims failed on appeal.
How courts treat agents that talk to servers directly.
Whether the Irish case against eDreams reaches a ruling on automated access itself.
02 · How the demand matureda progression, not a timeline
Novelty
Agents log in and book for the traveller inside seller accounts.
Retention
Sellers answer with closed systems, mandatory login and anti-bot barriers.
Willingness to pay
Some intermediaries now pay the airline directly for flights, trading access for a working relationship.
Category
Admission to the booking page becomes a legal status, settled in court.
03 · Where the market goesthe forks, not a prediction
→Terms decide admission: courts enforce account walls and terms against agents, and each seller sets its own list of allowed agents.
→The user-access reading spreads, and agents directed by a traveller book freely wherever a login allows them.
→Direct server access by agents is treated differently, splitting agents into admitted and barred kinds.
→Sellers license agents by agreement, and litigation gives way to paid access.
The forks turn on whether courts weigh the traveller’s instruction or the seller’s terms more heavily when an agent arrives to book.

The panel on this signal
They agreed on
–Courts, not platform policy alone, are now setting which agents may book, and terms still carry legal weight.
–The hacking route has narrowed for agents a user directs.
–The Irish ruling is procedural, so the travel question of automated access remains open.
The airline revenue-integrity analyst disagreed on
–Walls exist to stop bookings the airline cannot contact or service, so identity, not access, is the real dispute.
