Display Neutrality

The European Commission proposes neutral ranking on transport booking platforms, replacing the 1989 reservation-display code. Its assessment names opaque AI rankings as a risk.

What is it?

Europe proposes one neutral-ranking law for every transport booking platform, replacing the reservation-display code that began in 1989. Whatever orders the list must order it fairly, a model included. Paid placement gets a label, and search engines stay outside.

Why now?

On 13 May 2026 the Commission published COM(2026) 231 and its impact assessment. The assessment says the risk of biased rankings has grown with the increasing use of AI. The fix is technology-neutral, and it is still a proposal before lawmakers.

Who’s in it
Builders — booking platforms whose ranking engines would face Article 7.
Buyers — travellers comparing flights and trains on screens they cannot see behind.
Gatekeepers — the Commission, Parliament and Council shaping the final text.
What’s at stake
Whether an AI-ranked booking list can be shown to be neutral when the ranking logic is hard to read.
Whether paid placement survives as a labelled option.
Whether answer engines stay outside the booking rules.
What’s unsettled
What the co-legislators change before the proposal becomes law.
How a platform shows that its ranking model is neutral.
Whether hotels, left out of the text, ever come under a similar rule.
02 · How the demand matureda progression, not a timeline
Novelty
Booking platforms order flights and trains with ranking engines travellers never see.
Retention
Operators pay for prominence, and the list quietly bends towards the payer.
Willingness to pay
Paid placement survives only as a labelled choice, and neutral order becomes the default.
Category
Neutral display becomes a condition of selling transport in Europe at all.
03 · Where the market goesthe forks, not a prediction
→Neutrality as proof: platforms must show how their ranking engines meet the criteria, and model-ranked lists face the same test.
→The co-legislators narrow the text, and neutral display stays a rule for traditional platforms only.
→Answer engines grow outside the search-engine exclusion and are pulled in as booking platforms.
→Hotels stay outside the text, and ranking disputes move to room bookings instead.
The forks turn on whether a ranking model that books transport is read as a booking platform or as a search engine.

The panel on this signal
They agreed on
–The proposal governs any ranking engine by outcome, and its AI concern sits in the impact assessment, not the articles.
–It is a proposal, and the final text may change.
–Search engines and hotels fall outside, which leaves much of AI travel discovery unregulated.
The airline distribution-standards engineer disagreed on
–Neutral ranking assumes comparable offers, but airlines now sell bundles that no shared criteria can fairly line up.
