Consent for a Clone

A model’s likeness can now be generated without her in the room, and the first lawsuits are asking who actually owns that face.

What is it?

A model’s face can now be regenerated by a brand without her ever standing in front of a camera again. New York has made written consent a legal precondition, spelling out scope, pay and duration. Whether that paperwork holds outside one state stays open.

Why now?

Photography once fixed a likeness to a single shoot, priced once and reused within that contract’s limits. Generative tools now let a brand extend a face indefinitely, past what anyone originally agreed to. A one-time asset turns infinitely reusable — and the law is only starting to catch that gap.

Who’s building it?

Retailers generating the images, alongside unions and legislators writing the consent rules around them.

01 · The market
Who’s in it
Builders — retailers and agencies generating and licensing digital replicas.
Buyers — brands wanting campaign imagery without paying for a repeat shoot.
Gatekeepers — state legislators, courts, and the unions negotiating scope.
What’s at stake
Whether a digital replica counts as reused photography or a new asset that needs its own negotiated fee.
Litigation exposure over images old paperwork was assumed to cover.
How much leverage the borrowed playbook truly holds here.
What’s unsettled
Whether the consent law spreads past New York, or stays local.
If brands treat consent as real negotiation, not a checkbox.
Who prices a likeness once it can be generated indefinitely, not just licensed once.
02 · How the demand matureda progression, not a timeline
Dispute
A model sues over a specific unauthorised use, forcing the question into court.
Statute
A state answers with written law, naming scope, pay and duration explicitly.
Organising
Unions and advocates borrow an adjacent industry’s playbook to press for real leverage over terms.
Norm
Consent paperwork becomes routine practice, not a defensive reaction to one lawsuit.
03 · Where the market goesthe forks, not a prediction
→One state’s law or a national standard — New York’s Fashion Workers Act may stay local, or become the template others copy.
→Brands could treat consent as routine paperwork, or as a genuine point of negotiation with real cost.
→The union playbook borrowed from actors may transfer cleanly, or prove a poor fit for fashion’s structure.
→Litigation could stay rare and case-by-case, or become a standing cost of doing campaign work.
The open question is whether a likeness is now owned property with real terms, or still just an old photo brands assume they can keep reusing.

The panel on this signal
They agreed on
–A likeness has become a licensable, ongoing asset, not a photography credit spent once and forgotten.
–New York’s statute sets a real template others may follow.
–The actors’ playbook gives models real, if still untested, negotiating leverage over terms.
The regulatory analyst disagreed on
–The statute in question applies within a single state’s jurisdiction; without comparable legislation or reciprocal enforcement elsewhere, brands operating outside that jurisdiction retain a straightforward path around its protections.
